Terms and Conditions — Evizz Marketplace & Delivery

These Terms and Conditions (“Terms”) govern your use of the Evizz website, mobile applications, and related services (collectively referred to as the “Services”).
Evizz operates a digital marketplace that connects customers, merchants (stores), and delivery drivers to facilitate ordering and delivery of goods.
By accessing or using the Evizz platform, you agree to these Terms.
1. About Evizz
Evizz provides a platform that allows:

customers to browse and order goods from participating merchants

merchants to list products or menus and receive orders

drivers to deliver orders to customers
Evizz facilitates the connection and delivery logistics, but the sale of goods is between the customer and the merchant.
Evizz does not manufacture, prepare, or sell the goods listed on the platform.
2. Eligibility
To use Evizz services you must:

be at least 18 years old
-
provide accurate account and contact information
-
use the platform only for lawful purposes
Evizz reserves the right to suspend or terminate accounts that violate these Terms.
3. Orders and Deliveries
When placing an order through Evizz:

you agree that the order will be transmitted to the selected merchant
-
delivery will be assigned to an independent delivery driver
-
estimated delivery times are approximate and not guaranteed
Delays may occur due to factors including:

merchant preparation time
-
traffic conditions
-
weather
-
driver availability
Evizz is not liable for delays outside its reasonable control.
4. Contract for Goods
The purchase contract for goods is between the customer and the merchant.
Merchants are responsible for:

product descriptions
-
pricing
-
product quality
-
food safety and regulatory compliance
Evizz does not guarantee the accuracy, quality, safety, or legality of goods provided by merchants.
If there is an issue with goods (incorrect item, damaged item, missing items, quality concerns), customers should contact the merchant directly. Evizz may assist with communication but is not responsible for merchant fulfilment.
5. Payments
Payments may include:

cost of goods purchased from merchants
-
delivery fees
-
platform or service fees
Payments are processed securely through third-party payment processors.
Evizz does not store full credit card or payment details.
6. Refunds and Cancellations
Refund and cancellation policies may vary depending on the merchant.
General rules:

orders may be cancelled before preparation begins
-
once a driver has been assigned or the order prepared, cancellation may not be possible
-
delivery fees are generally non-refundable once delivery has started
Refund requests for goods must typically be handled by the merchant.
7. Merchant Responsibilities
Merchants using the Evizz platform must:

provide accurate product listings
-
comply with food safety and licensing laws
-
prepare orders correctly and on time
-
maintain appropriate hygiene and quality standards
Evizz may suspend or remove merchants that fail to meet platform standards.
8. Driver Responsibilities
Drivers operate as independent contractors, not employees of Evizz.
Drivers are responsible for:

collecting orders from merchants
-
delivering orders to customers
-
handling goods with reasonable care
-
following delivery instructions
9. Platform Availability
Evizz aims to keep the platform available at all times but cannot guarantee uninterrupted service.
We may temporarily suspend services for:
-
maintenance
-
updates
-
security reasons
-
technical issues
10. User Conduct
Users must not:
-
provide false information
-
misuse the platform
-
harass merchants or drivers
-
interfere with deliveries
-
attempt fraudulent transactions
Evizz may suspend or terminate accounts for violations.
11. Intellectual Property
All content, branding, software, and technology used in the Evizz platform remain the property of Evizz or its licensors.
Users are granted a limited, non-transferable licence to access and use the platform for its intended purpose.
12. Limitation of Liability
To the maximum extent permitted by law:

Evizz is not liable for the quality or condition of goods supplied by merchants
-
Evizz is not liable for indirect losses arising from use of the platform
Evizz’s total liability relating to a delivery order shall not exceed the delivery fee paid for that order.
Nothing in these Terms limits liability where it cannot legally be excluded under UK law.
13. Account Suspension and Termination
Evizz may suspend or terminate user accounts if:

these Terms are violated
-
fraudulent activity is suspected
-
misuse of the platform occurs
Users may also request account deletion by contacting Evizz support.
14. Changes to These Terms
Evizz may update these Terms from time to time.
Updates will be posted on the website or mobile application.
Continued use of the Services after changes constitutes acceptance of the updated Terms.
15. Governing Law
These Terms are governed by the laws of England and Wales.
Any disputes relating to these Terms or the Services shall be subject to the jurisdiction of the courts of England and Wales.
